Terms of Service

These Terms of Service ("Terms") govern your access to and use of Par Diem, a service operated as a California business ("Par Diem," "we," "us," or "our"). By creating an account or using our service, you agree to these Terms. If you do not agree, do not use Par Diem.

1. Description of Service

Par Diem is an AI-powered golf companion platform. Features include AI-assisted trip planning, post-round coaching debriefs, coach chat, practice plan generation, in-round note capture, caddie notebooks, and golf community management. Some features require a paid subscription or Trip Pass.

2. Eligibility

You must be at least 18 years old to create an account and use Par Diem. By registering, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration

You must create an account to access Par Diem. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please notify us immediately at hello@pardiem.com if you believe your account has been accessed without your authorization.

4. Subscription Plans and Fees

Par Diem offers the following paid plans:

  • Pro — Monthly: $19.99 per month, billed monthly
  • Pro — Annual: $14.99 per month, billed as $179.88 per year
  • Trip Pass: $9.99 one-time fee per trip (not a recurring subscription)

A Pro subscription provides access to all coaching and trip planning features, including AI coaching chat, post-round debriefs, practice plans, caddie notebooks, and trip brochure generation. Free accounts have limited access to certain features. A Trip Pass grants Pro-level trip planning access for one designated trip only and does not include My Game coaching features.

All payments are processed by Stripe. By providing payment information, you authorize Par Diem to charge the applicable fees to your payment method. All prices are in U.S. dollars.

5. Trip Pass

A Trip Pass is a one-time purchase tied to a single designated trip. It grants access to Pro-level trip planning features — including AI itinerary planning, caddie notebooks, and brochure generation — for that trip only. Trip Passes are non-transferable. They do not provide access to My Game coaching features (Coach, Debrief, Practice Plan).

6. Cancellation and Refunds

Subscriptions: You may cancel your Pro subscription at any time through Account Settings or by contacting us. Your access continues through the end of your current billing period. We do not issue prorated refunds for unused time in a billing period.

Annual plans: If you cancel an annual subscription within 14 days of your original purchase date and have not meaningfully used the service (for example, you have not generated a brochure, completed a debrief, or had multiple coaching sessions), you may request a full refund by emailing hello@pardiem.com. Refund requests after 14 days are reviewed on a case-by-case basis.

Trip Passes: Trip Passes are non-refundable once purchased.

7. AI-Generated Content Disclaimer

Par Diem uses artificial intelligence to generate coaching suggestions, trip recommendations, practice plans, course strategy guides, and other content. This content is for informational and entertainment purposes only. It is not professional golf instruction, certified coaching, or expert advice of any kind.

AI-generated coaching is based on information you provide and general golf knowledge. It does not account for your individual physical condition, injury history, biomechanics, or other factors that a qualified PGA professional would consider in a lesson. We recommend consulting a certified golf instructor for personalized, in-person instruction.

Par Diem does not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated content, including but not limited to course recommendations, booking lead time estimates, weather assessments, and performance insights. Use this information as one input, not as definitive guidance.

Where you have connected a health or fitness app (such as Oura Ring), AI-generated coaching responses may incorporate your health and readiness data to provide context-aware suggestions. This does not constitute medical advice. Do not make health, fitness, or medical decisions based solely on Par Diem's AI coaching content. If you have a medical condition or health concern, consult a qualified healthcare professional.

8. Your Content

You retain ownership of the content you submit to Par Diem, such as your debrief entries, coaching chat messages, golf notes, trip plans, and profile information ("Your Content"). By using the service, you grant Par Diem a limited license to use Your Content solely to provide and improve the service, including to generate AI-powered coaching and trip features personalized to you.

You agree not to submit content that is false, misleading, unlawful, or that violates any third party's rights.

9. Acceptable Use

You agree not to:

  • Use Par Diem for any unlawful purpose or in violation of any applicable regulation
  • Attempt to access another user's account, data, or private information
  • Reverse engineer, scrape, copy, or redistribute any part of the Par Diem service
  • Circumvent any subscription gates, feature restrictions, or access controls
  • Use the service in any way that could damage, disable, or impair Par Diem's infrastructure
  • Submit automated requests or bots without our express written permission

We reserve the right to suspend or terminate accounts that violate these rules.

10. Intellectual Property

The Par Diem name, logo, design system, software, and all associated content and features are owned by Par Diem and protected by applicable intellectual property laws. Nothing in these Terms grants you a right to use our trademarks, trade names, or branding. You may not reproduce, distribute, or create derivative works from our service or content without express written permission.

11. Third-Party Links and Affiliate Relationships

Par Diem may include links to third-party services. Some of these links are affiliate links — if you click through and make a purchase or booking, Par Diem may earn a small commission at no additional cost to you. Affiliate commissions help fund the service and do not influence which services or properties we recommend.

Current affiliate relationships include:

  • KAYAK — Flight and car rental search links. Par Diem may earn a referral fee on bookings made via KAYAK.
  • Booking.com via CJ Affiliate — Hotel booking links in trip planning features. Par Diem participates in the CJ Affiliate Network as a publisher. CJ's tracking technology records click and transaction data when you use these links, as described in our Privacy Policy.

We are not responsible for the content, pricing, accuracy, privacy practices, or terms of any third-party site. Clicking a third-party link means you are leaving Par Diem and interacting with a service we do not control.

12. Connected Third-Party Apps

Par Diem allows you to optionally connect third-party apps and services — currently Oura Ring — to enrich your coaching experience with health and readiness data. Connecting a third-party app is voluntary and not required to use Par Diem.

By connecting a third-party app, you authorize Par Diem to access the specific data described during that app's OAuth authorization flow. You may revoke any connected app's access at any time from your My Game account settings. Revoking access removes Par Diem's ability to read future data from that app; historical coaching content generated before revocation is not retroactively altered.

Health and biometric data accessed through connected apps is processed in accordance with our Privacy Policy. Par Diem does not sell or share your health data with third parties, except as necessary to operate the service (for example, including readiness context in AI coaching prompts sent to Anthropic's API).

Par Diem is not affiliated with, endorsed by, or responsible for the practices of any connected third-party app. Your relationship with Oura (or any other connected service) is governed by that service's own terms and privacy policy.

13. Disclaimers

Par Diem is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will always be accurate or complete. Your use of Par Diem is at your own risk.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Par Diem and its owners, officers, employees, and agents will not be liable to you for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, profits, or goodwill — arising from your use of, or inability to use, the service. Our total cumulative liability to you for any claim shall not exceed the total fees you paid to Par Diem in the twelve months preceding the event giving rise to the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless Par Diem and its representatives from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the service, Your Content, or your violation of these Terms.

16. Changes to These Terms

We may update these Terms from time to time. We will provide notice of material changes by email or via an in-app notice. Your continued use of Par Diem after updated Terms take effect constitutes your acceptance of those changes. If you do not agree to updated Terms, you should cancel your account before the changes take effect.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Par Diem regarding your use of the service and supersede any prior agreements on the same subject.
